Mackey couple pleads guilty to animal cruelty charges following surrender of emaciated boxer

Renfrew, ON, (September 13, 2007) – On September 4, 2007 Jason Labine, 38, and Sarah Eno, of Mackey pleaded guilty in the Ontario Court of Justice, Pembroke, to one count of animal cruelty each under the Criminal Code of Canada, including wilfully neglecting to provide suitable and adequate food, water and care to a dog named Tyson.

Ontario SPCA investigators first attended Labine and Eno’s property on January 15, 2007 following a complaint regarding a boxer-type dog with a thin body condition and ears that were swollen, scabbed and dripping blood. Investigators observed the dog at the residence of Labine and Eno, but were denied access to the property by Labine.

Investigators returned to the residence on January 16, 2007 and executed an Ontario SPCA Act search warrant. Tyson was found chained to the wall of Labine and Eno’s porch by approximately three feet of chain, emaciated, bleeding, and without access to food or water. The Ontario SPCA issued Orders requiring Tyson to be examined by a veterinarian by 12:00 p.m. the next day. The following day, Tyson was surrendered to a local animal hospital and transferred into the care of the Ontario SPCA. Veterinary examination revealed Tyson to be very emaciated, with open, bleeding wounds at the ends of both ears.

Tyson was placed in a foster home and his improvements were monitored. After a month of care, he was pronounced to be in excellent health and was adopted into a loving home.

Jason Labine was sentenced to three months of house arrest followed by two years probation. Sarah Eno received a conditional discharge and two years probation. Labine and Eno were to remove all animals from their home within seven days of sentencing. They are not to own or have custody or control of any animal or bird for the term of the sentences and they are to permit any Agent of the Ontario SPCA, accompanied by a police officer, to search their home for animals without a search warrant.
