Whitby man found guilty on two counts under the Dead Animal Disposal Act

NEWMARKET, ON, (November 2, 2006) – Azeezur Hooseinny of Whitby, Ontario was sentenced in the Ontario Court of Justice, Lindsay on October 31, 2006 on two counts under the Dead Animal Disposal Act for failing to humanely kill a fallen animal, and moving a fallen animal before it had been humanely killed. The Act defines a “fallen” animal as one “disabled by disease, emaciation or other condition that is likely to cause death.”

On April 13, 2005 an investigator from the Victoria County Humane Society, an Ontario SPCA affiliate, attended Hooseinny’s property in response to a complaint. The investigator, Tina Jackson, found a live cow stuck in the mud, lying under the bucket of a backhoe. A rope encircled her body and a smooth trough extended away from her body into the centre of the muddy area – leading the investigator to believe that the backhoe had been used to drag the cow out of the mud.

The investigator immediately contacted a veterinarian to attend the property. After examining the cow the veterinarian recommended euthanasia to relieve the cow’s suffering. A field autopsy revealed that the cow was dehydrated and suffering from malnutrition. The veterinarian also recommended that the remaining 25 cattle on the property be removed to receive proper care.

Hooseinny was fined $2,000 for failing to humanely kill a fallen animal – the maximum amount for a first time offence – and $800 for unlawfully moving a fallen animal. Justice Jackson stated that while Hooseinny had made a bad decision to move the animal, she felt he had been trying to help the cow. She also noted that Hooseinny had left the property at 9:00 p.m. on April 12, 2006 and had not returned until nearly 8:00 p.m. the following evening – failing to contact a veterinarian and exhibiting a lack of due diligence.
